General Terms and Conditions


Please read this Agreement carefully before accessing or using the Service. By accessing or using any part of the Service, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you may not access the Service or use any services provided by the Operator. If these terms and conditions are considered an offer by the Operator, acceptance is expressly limited to these terms. 

1. DEFINITIONS

The following terms and conditions govern all use of the Talenote.com website and all content, services, and products available at or through Eastory or its respective services, including, but not limited to, the Eastory WordPress plugin and the Eastory API (collectively, the “Service”).

The Service is owned and operated by East Analytics Piotr Fudała (the “Operator”) seated in Cracow, Poland, NIP: 6321797933, REGON: 365186157, email: peter@talenote.com. The Service is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, the Privacy Policy), and procedures that may be published from time to time on this Site by East Analytics (collectively, the “Agreement”).

The Service is available for unregistered visitors (“Visitors”) and registered users (“Users”). The Users’ responsibilities and available functionalities are described below.

2. ACCOUNTS

If you register an account with the Service, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the Service or its further use. You must immediately notify the Operator of any unauthorized uses of the Service on your account or any other breaches of security with regards to the Service.

You are obliged to provide current and accurate information when registering an account.

The Operator may change or remove any content that is considered inappropriate or unlawful, or otherwise likely to cause Operator’s liability. 

The Operator will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

You are allowed to terminate your account immediately for any reason without prior notice.

3. PROVIDED SERVICES

The Service is cloud based application for creating presentations Including visual and audio element (photos, graphics and video files). 

In order to use the Service, it is necessary  to have device with access to the Internet correctly configured Microsoft Edge, Mozilla Firefox, Google Chrome, Safari or Opera web browser – in the current or previous version, with JavaScript enabled, an active and correctly configured e-mail account and/or Google account.

The consumer may withdraw from the contract within 14 days without giving any reason.

The conclusion of the contract consists in accepting one of the types of offered licenses under which the User receives access to an individual account with a specific disk space and transfer. Audiovisual materials needed to create a presentation are uploaded by users and stored in disk space made available under licenses purchased by the user.4. DISCLAIMER

You use the Service at your own risk. The Operator does not guarantee that Service will work with no interference and no errors will occur.

The Operator will not be liable for any damages or losses of profit resulting from using the Service or from lack of accessibility of the Service.

5. PERMITTED USE OF SERVICE

You may use the Service to publish content, as per the terms specified within this Agreement, on your own website. You may also use the Service’s name or logos and other brand elements that the Operator makes available in order to identify the source of the information or service.

6.  RESTRICTED USE OF SERVICE AND OPERATOR INTELLECTUAL PROPERTY RIGHTS

You may not use the Service to substantially replicate products or services offered by the Operator, including the republication of Eastory content or the creation of a separate publishing platform. If the Operator believes, in its sole discretion, that you have violated or attempted to violate these conditions, your ability to use and access the Service may be temporarily or permanently revoked, with or without notice. 

You may not copy, sell, broadcast, reproduce, replicate or distribute all intellectual property connected to the Service.

You may not use the service in a  way it violates applicable law regulations, particularly intellectual property rights.

7. RESPONSIBILITY OF USERS

If you operate the Service, comment using the Service, post material to the Service, post links on the Service, or otherwise make (or allow any third party to make) material available by means of the Service (any such material, “Content”), you are entirely responsible for the content and any harm resulting from that Content. That is the case regardless of whether the Content in question constitutes text, graphics, an audio file, or computer software. By making Content available, you represent and warrant that all parts of the Content are original, they do not break the copyrights of third parties nor any other legal conditions within the European Union.

8. PERMISSIONS FOR CONTENT

By creating, submitting and/or using Content with the Service you grant the Operator a worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt, translate, and publish the Content solely for the purpose of displaying, distributing, and promoting your Eastory profile. This license allows the Operator to make publicly-posted content available to third parties selected by the Operator (through Talenote.com, for example) so that these third parties can analyse and distribute (but not publicly display) your content through their services.

9.  CONTENT IN VIOLATION

Without limiting any of those representations or warranties, the Operator has the right (though not the obligation) to terminate or deny access to and use of the Service to any individual or entity for any reason, in the Service’s sole discretion. The Operator will have no obligation to provide any compensation.

10. SERVICE COSTS

Registration in the Service and its usage is free of charge. The Operator reserves the right to introduce payments for the Service.

11. COPYRIGHT INFRINGEMENT

As the Operator asks others to respect its intellectual property rights, it respects the intellectual property rights of others. If you believe that material located on or linked to by the Service violates your copyright, you are encouraged to notify the Operator. The Operator will respond to all such notices, including as required or appropriate by disabling all links to the infringing material. 

12. CHANGES TO THE AGREEMENT

The changes in this Agreement are possible due to constant updates of the Service. All registered Users will be notified about any changes before the changes take effect. By continuing to use the Service, you agree to the changes in this Agreement.

13. TRANSLATION

These Terms of Service were originally written in English (UK). We may translate these Terms into other languages. In the event of a conflict between a translated version of these Terms of Service and the English version, the English version will prevail. 

14. MISCELLANEOUS

This Agreement constitutes the entire agreement between the Operator and you concerning the subject matter hereof. Except to the extent applicable law, if any, provides otherwise, this Agreement, any access to or use of the Service will be governed by the laws of the Republic of Poland excluding its conflict of law provisions, and the proper venue for any disputes arising out of or relating to any of the same will be the Regional Court in Kraków, Małopolska, PL. 

The Terms come into force on the day of its publication on the Service website. The Terms are changed by publishing their new content on the Service website.

15. COMPLAINTS

The User may file a complaint if the services provided for in these Terms are not provided by the Service or are provided contrary to the provisions of the Regulations.

Complaints about the Store’s services should include: User’s identity data; the subject of the complaint and the period to which the complaint relates; circumstances justifying the complaint.

Complaints will be proceed within 14 days.
